STVR Insurance Guidance

The operator of an STVR should carry a dedicated short-term vacation-rental liability policy program. HOA property insurance typically protects common property and the association’s insurable interests; it does not adequately protect an owner or operator against claims arising from the unit’s guest operations, employees, vendors, advertising, or contractual obligations.

Recommended Coverage Program

 Considering that some STVR’s offer a unit with a swimming pool and/or golf-carts included in the rental package, the policies that mention these amenities should consider the coverage that mention these amenities: 

Essential Policy Wording

The policy must expressly permit the actual business activity. A normal personal homeowner policy may deny a claim if the carrier views frequent paid guest stays as an undisclosed business or transient-rental exposure.

Confirm that the declarations page and endorsements state coverage for:

  • Short-term vacation rental
  • Transient guest occupancy
  • Commercial letting or accommodation operations
  • The exact property address and unit number
  • The actual named insured: individual owner, operating company, property manager, or each as applicable
  • All relevant amenities: pool, balcony, dock, beach access, bicycles, golf cart, watercraft, gym access, or shuttle services
  • Hurricane, windstorm, flood, water damage, and business-interruption terms appropriate to the island and property location

Exposures the HOA Policy Usually Does Not Solve

The operator’s policy should address exposures that arise from the rental business rather than ownership of common elements:

  • A guest slips inside the unit because of a wet floor or defective furnishing.
  • A guest assaulted by a vendors' employees, robber or another guest.
  • A guest alleges food poisoning, unsafe cleaning chemicals, bedbugs, poor security, or inadequate warning of a unit-specific hazard.
  • A cleaner or caretaker is injured while working for the operator.
  • A guest is injured using a golf cart, bicycle, boat, dock, or pool service arranged by the operator.
  • Guest payment, passport, identity, Wi-Fi, smart-lock, or surveillance data is compromised.
  • A guest alleges wrongful cancellation, negligent booking handling, misrepresentation, or mishandling of security deposits.
  • A contractor causes damage or injures a guest while performing work inside the unit.
  • A catastrophic injury exceeds the owner’s primary liability limit.

STVR’s Vendor (Caretaker/rental pool) Insurance Requirements

Where the operator hires cleaners, maintenance companies, pool technicians, boat providers, drivers, or guest-service vendors, each vendor should provide evidence of:


  • Commercial general liability of at least US$1 million per occurrence
  • Workers’ compensation or equivalent statutory employment-injury coverage
  • National Insurance Board compliance where applicable
  • The STVR Operator and HOA named as additional insureds for the vendor’s work
  • Waiver of subrogation in favor of the operator and HOA
  • Auto or marine liability when the vendor provides transport, golf carts, boats, or water activities


The STVR operator should obtain contracts with indemnity provisions requiring the vendor to defend and indemnify the STVR operator and HOA for claims caused by the vendor’s acts, omissions, employees, subcontractors, or equipment.

Practical Insurance Requirement for HOA Rules

An HOA rule can require each short-term-rental operator to maintain:


  • Commercial general liability insurance specifically permitting vacation-rental use.
  • Minimum limits of US$1 million per occurrence and US$2 million aggregate.
  • A US$2 million–US$5 million umbrella policy where a unit has enhanced risk features.
  • Additional-insured status for the HOA, its directors, officers, employees, managing agent, and related operating entities.
  • Primary/non-contributory wording and waiver of subrogation where available.
  • Annual delivery of certificates, declarations, and actual additional-insured endorsements.
  • Notice of cancellation, non-renewal, material reduction, or change in coverage.
  • Separate coverage for pools, waterfront amenities, golf carts, boats, staff, alcohol service, and transportation where applicable.
  • An obligation to indemnify and defend the HOA independently of insurance, to the fullest extent permitted by applicable law.

Bottom Line

The minimum practical package is commercial general liability specifically endorsed for short-term rentals, a meaningful umbrella policy, business personal property and business-income coverage, and workers’ compensation if staff are employed. Add marine, golf-cart, auto, cyber, liquor, E&O, crime, and employment-practices coverage when the operator provides or controls those activities.


The policy must cover transient guest use and should name the HOA and its relevant management parties as additional insureds. Insurance supplements—rather than replaces—the operator’s contractual duty to defend, indemnify, and hold the HOA harmless for short-term-rental liabilities.
